Episode 86 of the Irregular Warfare Podcast examines U.S. Congressional oversight of irregular warfare activities.
Our guests begin by highlighting the difficulties associated with conducting congressional oversight of irregular warfare. They then unpack the complexities of the AUMF, the separation of Title 10 and Title 50 concerns, and the responsibilities of various committees in overseeing U.S. military actions. After that, they discuss the differences in these authorities and their interaction with war powers. Finally our guests discuss the implications for practitioners and policymakers alike.
Dr. Oona A. Hathaway holds the Gerard C. and Bernice Latrobe Smith Professorship of International Law at Yale Law School. She directs the Yale Law School Center for Global Legal Challenges and is an esteemed member of the Advisory Committee on International Law for the U.S. Department of State. Hathaway’s impressive career includes serving as Special Counsel to the General Counsel at the U.S. Department of Defense, and authoring numerous legal articles, to include Congressional Oversight of Modern War, which serves as the anchor for Episode 86.
Dr. Thomas Campbell held a distinguished career in Congress, serving as a United States Congressman for multiple terms from 1989 to 1993 and 1995 to 2001. His impactful tenure included contributions to both national and California state legislative bodies. In addition to being a congressman, Dr. Campbell served as Dean of the Fowler School of Law at Chapman University. He has also served as a law professor at the Haas School of Business at the University of California, Berkeley and a Professor of Law at Stanford University.
